1. AGREEMENT TO TERMSThese Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” "Merchant," or "User") and The Card Consultant LLC ("Company", "we", "us", or "our"), located at 432 W 1st N St, Suite 5, Morristown, TN 37814. By accessing and using https://thecardconsultant.com/ (the "Site") and our services, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions.

2. NATURE OF OUR SERVICES & AGENCY RELATIONSHIPThe Card Consultant LLC operates exclusively as an “Agent.” We hold "Agent" agreements with various independent "Payment Processing Companies" to board "Merchant Accounts" onto their respective "Processing Platforms."

By using our services, you acknowledge and agree to the following strictly defined operational boundaries:

• Third-Party Agreements: Any agreements signed by a "Merchant" to utilize payment processing services are solely between the "Merchant" and the respective "Payment Processor."
• No Direct Control: The Card Consultant LLC does not directly handle any billing, process credits, or possess direct control over any "Merchant Account."
• Account Actions: All actions relating to the merchant account—including but not limited to account changes, account closures, billing charges, cancellation fees, and non-returned equipment fees—are governed entirely by the contract between the "Merchant" and the "Payment Processor."
• Assistance Only: The Card Consultant LLC can only assist a Merchant with making account changes if we have the Merchant's explicit consent, and any assistance provided must strictly follow the specific "Payment Processor's" instructions and protocols.

3. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, The Card Consultant LLC, its officers, employees, and agents hold no liability whatsoever on Merchant Accounts. Because our role is limited to consulting and acting as an introductory Agent, we shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from disputes, financial losses, withheld funding, equipment fees, or contract cancellations between you and the Payment Processing Companies.

4. USER REPRESENTATIONS By using the Site to book appointments, create an account, or submit contact forms, you represent and warrant that: (1) All registration and contact information you submit will be true, accurate, current, and complete; (2) You have the legal capacity and authority to enter into agreements on behalf of your business entity.

5. INTELLECTUAL PROPERTY RIGHTS Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site are owned or licensed to us, and are protected by copyright and trademark laws.

6. GOVERNING LAW These Terms shall be governed by and defined following the laws of the State of Tennessee. The Card Consultant LLC and yourself irrevocably consent that the courts of Hamblen County, Tennessee shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
